Terms of Service

These terms govern the relationship between MyFoodFast Ltd (“we”, “us”, “our”) and the takeaway business or individual (“you”, “Customer”) that subscribes to our software, hardware or services. Please read them carefully. By creating an account or using the Services you agree to be bound by these terms.
1. Definitions
- “Services” means the MyFoodFast online ordering site, POS, KDS, kiosk, branded mobile app, driver app, automated marketing, platform integrations, collection display and any other product offered by us from time to time.
- “Account” means the back-office account you create at sign-up.
- “Subscription Fees” means the recurring monthly fees listed on our pricing page at the time you subscribe or renew.
- “Customer Data” means content, menus, orders and other data you upload to or generate within the Services.
2. Eligibility
You must be at least 18 years old and authorised to bind the business you represent. The Services are made available for use by takeaway businesses operating in the United Kingdom. We may decline to onboard, or suspend, any business at our discretion (for example, if KYC checks fail).
3. Account & Security
- You are responsible for keeping your login credentials confidential.
- You must notify us promptly at hello@myfoodfast.com if you suspect unauthorised access.
- You are responsible for the actions of any user you grant access to your Account.
4. Subscription, Fees & Payment
Subscription Fees are charged monthly in advance. Where you process card payments through our online ordering Services, transaction fees apply in addition to Subscription Fees:
- Online ordering: 1% MyFoodFast fee plus Stripe’s standard processing fee.
- Automated Marketing (when enabled): 1% on revenue attributable to marketing-driven card orders.
- Hardware purchases (e.g. Sunmi terminals) are one-off charges separate from your Subscription Fees and are not refundable once dispatched, except as required by UK consumer law where applicable.
All fees are exclusive of VAT, which we will add at the prevailing rate where required. We may change our prices on at least 30 days’ notice; if you do not accept a price change you may cancel before it takes effect.
5. Cancellation
There are no fixed-term contracts. You may cancel any Service for any reason from the back office. Cancellation takes effect at the end of your current billing period; we do not pro-rate partial months. Hardware previously delivered remains yours.
6. Acceptable Use
You agree not to:
- Use the Services in breach of any UK law or regulation;
- Sell goods you are not legally entitled to sell (including age-restricted items in violation of licensing rules);
- Upload content that is infringing, defamatory, misleading or deceptive to customers;
- Use the Services to send unsolicited marketing in breach of PECR or GDPR;
- Attempt to circumvent security controls, reverse-engineer, or place excessive automated load on the platform;
- Resell, sublicense or rebrand the Services as your own outside the features we provide for that purpose.
7. Intellectual Property
The Services, including all software, designs, branding and documentation, are owned by MyFoodFast Ltd and our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services during your subscription. You retain ownership of your Customer Data; you grant us the rights necessary to host, process and display it for the purpose of providing the Services.
8. Third-Party Services
Some Services rely on third parties (for example Stripe for payment processing, the Just Eat / Uber Eats / Deliveroo APIs for platform integrations, Twilio for SMS, Google for Maps and Analytics). Your use of those features is also subject to the relevant third party’s terms. We are not responsible for outages or behaviour of third parties beyond our reasonable control.
9. Data Protection
Each party will comply with the UK GDPR and the Data Protection Act 2018. For personal data of your customers, you are the controller and we are the processor; the way we process such data is described in our Privacy Policy. For the personal data we collect about your account holders and end users on our marketing site we are the controller.
10. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We may perform planned maintenance, normally outside peak hours, and will give reasonable notice where practicable. Emergency maintenance may be performed without notice.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law we exclude all implied warranties, conditions and other terms (including any implied terms as to satisfactory quality, fitness for a particular purpose, or use of reasonable care and skill) other than those that cannot be excluded under UK law.
12. Limitation of Liability
Nothing in these terms limits or excludes liability that cannot be limited or excluded under UK law (including for death, personal injury caused by negligence, or fraud). Subject to that:
- We will not be liable for any loss of profit, revenue, business, goodwill, anticipated savings or for any indirect or consequential loss.
- Our total aggregate liability arising out of or in connection with the Services in any 12-month period will not exceed the Subscription Fees you paid us in that period.
13. Termination
Either party may terminate for material breach not remedied within 30 days of written notice. We may suspend or terminate access immediately if you fail to pay, breach the Acceptable Use rules, or if we reasonably believe the Services are being used unlawfully. On termination, you may export your Customer Data for 30 days after which we may delete it (subject to retention obligations described in the Privacy Policy).
14. Changes to These Terms
We may update these terms to reflect changes in our Services or applicable law. We will notify you of material changes at least 30 days in advance. If you do not accept the changes you may cancel before they take effect; continued use after the effective date constitutes acceptance.
15. Governing Law & Jurisdiction
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from or relating to them, except that we may bring proceedings to enforce unpaid fees in any competent court.
